Service Terms and Refunds
Version 2026-10-16.1. Effective for a customer on actual affirmative acceptance; publication alone does not record acceptance.
1. Parties and agreement
Castframe is provided by Theo Pantazi, trading as Castframe, of Tagliaferro Business Center, High Street, Sliema, Malta SLM 1549. General support: support@castframe.app. Privacy and processing instructions: privacy@castframe.app.
The customer identified in the acceptance record is Customer. These Castframe Service Terms, version 2026-10-16.1, together with the accepted order/Checkout particulars and, where applicable, the Castframe Data Processing Agreement, version 2026-10-16.1, form the Agreement. It becomes effective for Customer when Customer or its authorized representative affirmatively accepts the identified documents. A person accepting for an organization confirms authority to bind it. Read our Privacy Policy, Cookie and Browser Storage Notice and DPA. The DPA prevails for its personal-data-processing subject matter; mandatory law prevails over inconsistent terms.
2. Service and account
Castframe provides supported banner-design, saved Campaign, asset, rendering and export features according to the applicable plan and technical limits. Each account is for one person; payment or organizational billing does not create team/admin privileges. Keep credentials secure, provide accurate necessary account information and contact support promptly about suspected unauthorized access.
Standard is €19/month for supported static creation and PNG export. Pro is €39/month and adds supported animation/HTML5 export. The actual recurring total, applicable taxes and billing particulars must be displayed before purchase and recorded with the order; these terms do not determine a tax exemption or change existing tax configuration. Individually agreed complimentary access retains its stated scope.
Subscriptions renew monthly until canceled. Cancellation of renewal takes effect at the verified paid-period end and can be reversed before then through the available Billing flow. At launch, Standard/Pro switching within a subscription is unavailable. Verified past-due renewal coverage includes the existing three-day grace after the last paid period; initial unpaid purchase has no renewal grace. Payment-method/invoice access remains available through Billing.
There is no automatic paid conversion from a no-card trial. Where a trial is expressly offered, its stated eligibility/start/end rules govern; a verified early purchase starts paid coverage immediately and ends unused trial time. These terms do not activate or advertise a trial that the service has not offered to Customer.
3. Customer content and permitted processing
Customer retains its rights in its content and supplies the permissions needed to upload, use, render and export images, text, logos, fonts and other material. Customer grants Castframe the limited permission needed to provide and secure the instructed service, including necessary processing by the disclosed service providers. This is not permission to sell Customer content, use it for unrelated advertising or train Castframe models on it.
Use the service lawfully, respect others' rights and avoid introducing malicious code or attempting unauthorized access. The service does not solicit regulated sensitive datasets. Intentional processing of special-category/criminal-offence datasets requires a prior suitability/instructions assessment and an arrangement permitted by the relevant providers; ordinary creative functions do not establish such an arrangement automatically.
For Customer-controlled personal data, Customer supplies lawful instructions and its own basis/notices; Castframe's processor duties are in the DPA. Castframe's controller processing of account, billing, trial, security and support records is described separately in the Privacy Policy. Controller retention is not incorporated into the DPA's Customer-content schedule.
4. Customer-directed OpenAI
Optional AI uses Customer's own OpenAI account/key and is billed separately by OpenAI. Customer contracts directly with OpenAI; it is a customer-directed third-party service, not a Castframe-appointed subprocessor for this arrangement. Customer directs Castframe to transmit the selected generation inputs using that key and return the output. Castframe remains responsible for its own instructed handling through its hosting/API. Customer's agreement/settings govern OpenAI's own processing.
The current key is stored as text in browser-wide localStorage, without isolation between Castframe accounts in the same browser. It transits Castframe's API during generation; reviewed generation handlers do not save it to a database or create a separate prompt archive. Prompt fields and generated content saved in Campaigns or browser caches can remain under ordinary storage rules. Remove the key on each device and revoke it with OpenAI when appropriate. No zero-retention or EU-only OpenAI promise is made.
5. Saved work, exports, return and deletion
Paid/trial expiry or renewal cancellation leaves saved work viewable, with creative writes, new exports and new AI requests restricted under the access policy. It is separate from closure or an instruction to delete content. There is no automatic dormant-content purge; the adopted policy provides a necessity review after twelve months of inactivity, then annually.
Customers should retain their own copies of the original images, logos, fonts and other assets they upload, and download exports they wish to keep. Exports are temporary and are not included in Castframe’s weekly backups. Completed HTML5 delivery expires after 24 hours from completion, followed by scheduled physical cleanup with the existing two-day object-lifecycle fallback measured from upload. Access expiry and physical deletion are distinct; neither the next cleanup run nor all-provider erasure is guaranteed at exactly 24 hours. Source files have a different retention purpose; the current backup scope includes selected uploaded originals as described in DPA Schedule B and may be reviewed as their combined size/cost grows. This advice does not limit Castframe’s DPA duties or Customer’s return/deletion rights. Castframe cannot recall downloads or clear every device’s local storage.
Customer can request secure return or deletion of Customer Personal Data as set out in the DPA. The ordinary active-system cleanup target is 14 calendar days after a clear, sufficiently verified instruction, with prompt action where required, agreed return sequencing and specific lawful retention/copy limits. It is not an all-provider erasure guarantee. Castframe must report actual completion and any pending or retained scope honestly. Separate controller-record duties and statutory rights remain.
6. Support, restrictions and service changes
Use support@ for service/billing issues and privacy@ for processing instructions. There is no contracted staffed 24-hour support desk, guaranteed uptime or numerical recovery-time commitment in this Agreement. Applicable duties to maintain appropriate security and assist Customers remain.
Castframe may restrict affected processing where reasonably necessary for security, unlawful instructions or material misuse, using proportionate measures and explaining the reason/review route where permitted. Such restriction does not authorize erasing unrelated content, restarting trials or taking an unrequested financial action. Material contractual changes require appropriate notice and agreement where necessary; they do not retrospectively remove mandatory rights.
7. Refunds, mandatory rights and subprocessor objections
Contact support@ with the account/invoice reference and reason for a refund request. Cancellation and refund are separate; no blanket no-refund rule or waiver of consumer withdrawal, conformity, refund or other mandatory rights is imposed. Castframe assesses the actual transaction and applicable rights. If you are an EU consumer buying a service online, a statutory fourteen-day withdrawal period generally applies from conclusion of the service contract, subject to the applicable rules. To exercise a right, send support@castframe.app a clear statement identifying the subscription and your decision to withdraw; no special form is required. We do not treat use, a purchase or a trial-conversion acknowledgement as a waiver of withdrawal rights. Where applicable, refunds are made without undue delay and within fourteen days after notice, using the original payment method unless otherwise agreed without fees. Any lawfully applicable proportionate charge or exception requires the conditions and pre-contract information/express request that the law actually requires. Rights for a faulty or non-conforming service remain separate.
Where a reasonable data-protection objection to a subprocessor change cannot be resolved through an available compliant alternative, Customer may terminate the affected service before the disputed processing begins. Castframe will return prepaid fees attributable to the unused affected service period and arrange Customer-selected return/deletion. This does not waive a claim or other mandatory remedy. The operator verifies scope and performs any actual financial action separately; drafting this remedy makes no refund transaction.
8. Liability, law and communications
Each party remains responsible for its applicable contractual and legal obligations. These Terms impose no monetary liability cap, indemnity, forced arbitration, exclusive court or consumer-law waiver. Applicable law and mandatory jurisdiction rules govern where the Agreement does not otherwise provide. Privacy/DPA communications use the verified Customer account contact unless Customer designates an authorized service/privacy contact. Contract acceptance must identify the accepted documents; silence or an account's mere existence is not backfilled as acceptance of this Terms.
